This is an recent email sent out from our CEO Amber Williams as a final reminder on our invitation to be included on below.
As you would be aware, one of the roles in which Resolution Institute acts is as a nominating body for expert determiners.
It currently draws upon the list of grade 1 and 2 arbitrators for that purpose, but has resolved to set up a register of practising expert determiners (Register) so that it is more easily able to identify members with qualifications and experience matching the issues in the dispute for which it has been requested to provide a nomination.
The Register is to be compiled in two stages.
Initial Register
The requirements and assessment criteria for members wishing to apply for inclusion on the Initial Register are set out in section 2 of the Transitional Expert Determiners Policy.
Applicants should note the requirements of section 2.2, which states that a "… person will not be eligible for inclusion on the Initial Register unless the applicant can demonstrate that he or she has been engaged as an expert determiner or arbitrator in at least 4 expert determinations or arbitrations and issued at least 2 final expert determinations".
Applications should be made in writing to the CEO of Resolution Institute in the prescribed form no later than 19 February 2021 and accompanied by a non-refundable application fee of $300 (includes GST).
The Transitional Expert Determiners Policy will cease to have any further operation or effect following the Determinative Committee's assessment of all applications made in accordance with the Transitional Expert Determiners Policy and submission of a report and recommendation to the Board.
Ongoing Register
The requirements and assessment criteria for applications made by members after 19 February 2021 are set out in sections 2 to 9 of the Expert Determiners Policy.
Such requirements include but are not limited to provision of a certificate of satisfactory completion of the Resolution Institute's Expert Determination Course or Accelerated Expert Determination Course, attending an Assessment Panel Interview, accumulation of a minimum number of CPD points and evidence of having at least two decisions relating to arbitral, adjudicative or other matters and other documents to demonstrate a high level of literacy and analysis.
Important notes to completing the prescribed form
- It is recommended that you look at each page of the form to see what is required before commencing to fill it out.
- You will be required on page 3 of the form to upload two expert determinations together with associated directions to the parties. It is therefore recommended that you PDF and if you wish, password protect those documents prior to commencing to fill out the form. It should then take you less than 1/2hr to complete the application if you have already prepared the files in that manner. Instructions for sending the document password(s) to the evaluation panel are noted on page 3 of the form.
- Unfortunately the Sharepoint software on which the prescribed form is based does not progressively save the information you enter and saves it only when you hit the 'Submit' button on the last page (page 5). As a result, your information will be lost and you will need to start again if you close your browser prior to completing and submitting your application.
