    I just wanted to draw members' attention to an article I have published in relation to the subject of confidentiality and disputant participation in court-connected mediation.  The article has appeared in the peer-reviewed Newcastle Law Review which is a publication of the University of Newcastle NSW.  The reference for any interested readers is (2020) NewcLR Vol. 15 p 53.  I commend the article to your attention because it reports one of the major issues which arose from my PhD research and touches upon the subject of another article to which I referred in my last post on this blog which attracted some interest from readers.  A copy of the current edition of the Newcastle Law Review is attached for your information.

                 great article, the confidentiality and the participation of disputant is very sensitive especially to enhance and/or encourage active participation, however, legally there is an obligation on lawyers, parties to keep up with confidentially. what is the interesting point is how to give guarantee for the participants that confidentially will be always upheld.

    Thanks John - I enjoyed this paper

    The important differentiation of interest-based vs rules-based disputant participation is well covered in this paper and the topic of confidentiality is clearly explored - a useful and informative reference
